Begoña Gómez asks the Madrid court not to take two months to decide whether to bring order to the case of Judge Peinado

The defense of Begoña Gómez, wife of the President of the Government, has asked the Provincial Court of Madrid to advance its deliberation on the appeals filed against the instruction of Judge Juan Carlos Peinado, which were set for September 30. In a plea, to which elDiario.es has had access, Gómez's defense assesses the judge's decisions and concludes that there are “serious violations” of Gómez's rights.

Defense attorney Antonio Camacho expresses his understanding of the way the Provincial Court handles the appeals, in order of filing, but adds: “This party is also aware that a late judge can cause irreparable damage to the right to defense of those being examined.”

The lawyer recalls that despite the fact that the Provincial Court of Madrid itself has set limits to Peinado's investigation, the judge has continued to carry out a “mutant” investigation, repeatedly changing the subject of the facts he is investigating.

Since the European Public Prosecutor's Office took over the investigation into the only facts that could be investigated, the investigation has remained “substantively empty”, according to the decision of the Provincial Court of Madrid, Camacho writes.

“However,” he adds, “the instructor began to agree to investigation procedures and multiple statements that affected the rescue of Globalia/Air Europa and also the alleged irregularities at the Complutense University of Madrid. That is, those issues that, in accordance with the order of this section cited above, were excluded from the investigation.”

As a result of these and other decisions, Gómez's defense concludes: “This party and the rest of those investigated are subject to an indefinite, future and continuously growing investigation, without guarantees, that seriously harms the right to defense.”

Among all the facts reported by Begoña Gómez's defense are also the changes in the status of businessman Juan Carlos Barrabés and the rector of the Complutense University, Joaquín Goyache, after they had given statements as witnesses.

Section 23 of the Provincial Court of Madrid recorded last Tuesday, September 30, the deliberation and ruling on the appeals filed against the investigation of Peinado by Gómez's defense and the Public Prosecutor's Office.

The same day, Gómez's defense filed an appeal the summons of Sánchez as a witness. Since the appeals filed are in order and there are others, the resolution of the Provincial Court on the questioning of the President of the Government would be postponed until October at least.
