In November 2023, the People's Advocate reported to the Constitutional Court with similar arguments to real estate speculators in the debate on the Urban Planning Code. The Constitutional Court will decide tomorrow, November 7. I formulated an opposing point of view (the so-called amicus curiae). The People's Advocate asked the Constitutional Court to interpret the law to mean that granting permits based on PUZs that are proven to violate the law can still be carried out. Therefore, this will nullify all our efforts to overturn the PUZ which is clearly illegal. The People's Lawyer said: “The cancellation of building permits (…) as a result of the cancellation (…) of urban planning documentation for the simple reason that (…) legal proceedings are pending (…) causes enormous damage to substance of property rights”, said Nicuşor Dan.
