The Judicial Labyrinth by Mónica Oltra

When it seemed that the judicial horizon of Monica Oltra was cleaned up, things have become even more complicated. The decision of the court of Valencia of reopen the case that continues against the former vice-president of the Generalitat Valenciana and fifteen other people under investigation is a new twist in a long process that has its advantages. origin in December 2021precisely in a decision of the same provincial body.

Contrary to the criteria of the judge and prosecutor of investigation number 15, which support the archiving of the proceedings, the magistrates of the Fourth Department believe that there is sufficient evidence that they all attempted to archive the case. hiding sexual abuse from ex-husband from the leader of Compromís – a teacher in a shelter – to a 14-year-old minor under guardianship. All indications are that an oral trial will be opened against Oltra herself, part of her team from the Department of Equality and Inclusive Policies, and two employees of the arranged residence where the events took place between 2016 and 2017.

The same argument used in the first conviction – the trial had to be partially repeated with the same result – the Court also uses against Luis Ramírez Icardi, who is currently serving a five-year prison sentence after the Court upheld the Supreme decision.

That 2019 statement pointed it out helplessness that the victim had suffered, after being told what had happened, by those who were obliged to protect her. Moreover, he attacked the controversial file opened within the ministry when the case had already been judicially dealt with, describing it as a “parallel” instruction. The Valencian TSJ also criticized the attitude of the Generalitat in 2021.

In doing so, the victim, represented by the lawyer and leader of Spain 2000, José Luis Roberto, has taken this alleged lack of protection to court. His complaint was added to a complaint filed against Oltra by the former leader of Vox Cristina Seguí and gave rise to the current case, in which Santiago Abascal's party is also making the popular accusation. Although the instructor initially advocated waiting for the Supreme Court to rule on the sentence against Icardi, the court ruled that these were cases that could be dealt with in parallel.

The story of events goes back to 2017, at that time, Oltra was already head of minors policy in the Valencian Community, having come to power two years earlier alongside Ximo Puig's PSPV, and was still married to Icardi. That link has always been the common thread that ties together all suspicions against her and the rest of those investigated, who supposedly consented. cover up what happened and prevent it from coming to light because of the political and media consequences it ultimately had. They all categorically denied it in court: they limited themselves to following the current protocols without pressure.

On February 20 of that year, the minor disclosed the abuse – which she had been suffering from for months – to people she trusted in the center. They did not give any credence to her testimony after preparing an internal report, so no complaint was filed nor included in the prosecutor's file on the young woman. In June, the victim knocked on the door of two police officers who showed up at the house for a different reason. The officers informed the Public Prosecution Service, which began requesting information from the ministry about what had happened.

Impeachment and dismissal

Although she lived with the aggressor, Mónica Oltra has always defended that she then learned of the abuse On August 4, he received a court notice at his home. That is, because of his personal condition and not because of his position. At that point, he asked his chief of staff to gather information and ensure the girl's protection.

Four days later, after a restraining order had already been issued, Equality opened a file containing confidential information about what happened, “to verify, where necessary, the veracity of the facts.” This is the main point of the matter: Who ordered that file opened and why?. The court understands that there is sufficient evidence to believe that an attempt has been made to defame the minor.

During their appearances as defendants, both the director and deputy general manager of Childhood and Adolescence, Rosa Molero and Gemma Plaza, denied that Oltra had provided any guidance. Both defended that they had opened the procedure on their own when they learned of the facts from the territorial management, warned by the Public Prosecutor's Office.

However, and after some contradictory statements made by the former Vice President to the media, the head of the Investigative Court Number 15 of Valencia referred the case to the Supreme Court of the Valencian Community in order to investigate the person certified at the time, due to her status as a substitute.

The TSJ charged her in an open trial for alleged crimes of subterfuge, abandonment of minors and failure to prosecute crimes. He returned it to the original organ when, after several weeks of intense pressure, even from his own formation, Oltra has resigned from all his positions pointing to the far right as responsible for a dirty war in the courts.

At the doors of the oral trial

Almost two years after the press conference that ended the compromise leader's political career last April, the same instructor decided to temporarily dismiss the case. During all this time the accusations came they have not stopped requesting the execution of procedures, although no one has proven their arguments. The most expensive was the legal analysis of the official emails sent between the people under investigation at several key periods in the story of events.

Nevertheless, the Court of Valencia understands that “the commission of a criminal offense cannot be clearly excluded, and that it is possible to identify, in relation to certain actions, a sufficient body of evidence that justifies the continuation of the proceedings.” In practice, this new decision of June 20, against which there is no appeal, leads the sixteen persons investigated to the oral hearing.
